Four fishing vessel crewmen face jail time for stealing fish

The Malabon City Prosecutor’s Office successfully prosecuted a case involving the theft of eight tubs of fish worth P16,000 in 1998.

In a five-page Decision, the Malabon City Regional Trial Court – Branch 74 found Jessie Alcovendas, Leopoldo Sebullen, Jimmy Calinao and Elorder Bañez, all crew members of the Analyn VIII vessel owned by Lynvil Fishing Enterprises, Inc., guilty of Qualified Theft (Article 308 in relation to Article 310 of the Revised Penal Code) and were sentenced to a penalty “of one (1) year of prision correccional.”

Assistant City Prosecutor Gilbert Cruz of the  Malabon City Prosecutor’s Office filed an Information against the four for  stealing “eight (8) tubs of fish consisting of tanguigi and pampano” worth P16,000 from Lynvil.

In its ruling, the court said “all the elements of the crime of Qualified Theft are present.xxx It was clearly established that accused xxx took fish from the warehouse of the fishing vessel named ‘Annalyn 8’ owned by private complainant corporation.”
