DOJ assures Honasan impartiality in the coup charges
August 14, 2003
Justice Secretary Simeon Datumanong urged today
Senator Gringo Honasan to come out and face the coup
d'etat charges imputed against him, with assurance of
impartiality in the course of the investigation.
Datumanong said the senator need to resurface to swear
in his counter-affidavits before the prosecutors.
"Kailangan mag-appear siya sa prosecutor to subscribe
his counter--affidavits. Hindi pa ginawa ng
prosecution ang magpunta sa respondent, parang
kitang-kita yung special treatment," he stressed.
However, the justice secretary said that if the
senator requests, he is willing to have his affidavits
sworn to at the Senate, "We will send somebody there",
he said. Datumanong made it clear that the move was
not giving him undue privilege, but in recognition of
the fact that he is a senator of the Phils. and in
order to insure that he is given full opportunity to
air his side and refute his baseless and unfounded
claim that he is being unjustly persecuted.
As this developed, the justice secretary also said the
DOJ will conduct the preliminary investigation on the
case of AFP young officers involved in the July 27
failed mutiny, following an order by Makati City RTC
Judge Barza.
Datumanong said subpoena are ready to be dispatched
anytime this week, and that the preliminary
investigations are being considered to be held in Camp
Aguinaldo considering the number of the soldiers
involved.
